A trial is needed to determine if the song Led Zeppelin , “Stairway to Heaven” , plagiarized the opening notes of a melody of the rock band Spirit , declared a federal judge.
district judge R. Gary Klausner ruled Friday that lawyers administrator of the estate of the deceased guitarist Spirit Randy Wolfe, gave enough evidence to support the case that “Stairway to Heaven” plagia the music of the song “Taurus” Spirit.
“Taurus” was written by Wolfe in 1966 or 1967, years before Led Zeppelin presented “Stairway to Heaven” in 1971. Klausner wrote that although the melodies have some differences, lawyers administrators Wolfe could prove that they are substantially like.
Led Zeppelin and Spirit made some tours and festivals around the same time, but not on the same stage. Klausner wrote that part of the evidence presented so far represents a circumstantial case that Led Zeppelin could have heard “Taurus” before creating “Stairway to Heaven”.
Messages left after hours to Helene M . Freeman, Led Zeppelin’s lawyer were not immediately returned. Experts hired by the band say that both “Stairway to Heaven” and “Taurus” used notes which have been used for centuries.
Francis Alexander Malofiy, attorney trustee Wolfe, Michael Skidmore, applauded the ruling . He said that although many cases of plagiarism are difficult to win, the decree Klausner about a step his client to give Wolfe credit for helping to create one of the most recognizable openings in rock history.
Skidmore was able to rid obstacles of limitations to file the demand against “Stairway to Heaven”, because the song was remastered and re-launch in 2014.
